Agreement to Terms

By accessing or using BankDataPro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Service Description

BankDataPro provides automated conversion of PDF bank statements into structured data formats including CSV, JSON, and QuickBooks. Our service uses advanced OCR and AI technology to extract transaction data from financial documents.

The Service is provided on a credit-based subscription model, where credits are consumed based on the number of pages processed.

User Accounts

Account Creation

To use our Service, you must create an account by providing a valid email address. You may authenticate using:

• Email-based login links (passwordless authentication)
• Third-party authentication providers (Google, etc.)

Account Responsibility

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Payment and Billing

Subscription Plans

We offer multiple subscription tiers (Starter, Professional, Business) with varying credit allocations. Pricing is clearly displayed on our pricing page.

• Subscriptions renew automatically on a monthly or annual basis
• Credits are allocated at the start of each billing period
• Unused credits do not roll over to the next billing period
• You can cancel your subscription at any time

Payment Processing

All payments are processed securely through our payment processor. We do not store your credit card information.

Refund Policy

We offer refunds within 14 days of purchase if you have used less than 10% of your allocated credits. Refund requests must be submitted to support@bankdatapro.com. Refunds are processed within 5-10 business days.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will retain access to your credits until the end of the paid period.

Credit System

• Credits are consumed based on the number of pages processed in your documents
• 1 credit = 1 page processed
• Failed conversions do not consume credits
• Credits are non-transferable and have no cash value
• Credits expire at the end of each billing period
• We reserve the right to adjust credit pricing with 30 days notice

Acceptable Use Policy

You agree to use the Service only for lawful purposes. You may not:

• Upload documents containing illegal content or obtained illegally
• Attempt to reverse engineer, decompile, or hack the Service
• Use the Service to process documents you do not have rights to
• Share your account credentials with others
• Use automated tools to abuse or overload the Service
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content

File Retention and Deletion

To protect your privacy and security:

• Uploaded files are automatically deleted after 24 hours
• Converted data files are also deleted after 24 hours
• You are responsible for downloading your converted files before expiration
• We do not provide recovery of expired files
• Deleted files cannot be recovered

We recommend downloading your converted files immediately after processing.

Intellectual Property

The Service, including all content, features, and functionality, is owned by BankDataPro and protected by copyright, trademark, and other intellectual property laws.

You retain all rights to the documents you upload and the data you extract. We claim no ownership over your financial data.

Disclaimers and Limitations

Service Accuracy

While we strive for high accuracy in our conversions, we cannot guarantee 100% accuracy. You are responsible for verifying the accuracy of converted data before using it for business or financial decisions.

"As Is" Provision

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, BankDataPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Experience unexpected downtime due to technical issues
• Modify or discontinue features with notice
• Impose usage limits to ensure fair access for all users

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• Your account is used for fraudulent or illegal activities
• You engage in abusive behavior toward our staff or other users
• Your payment method fails or is disputed

You may terminate your account at any time by canceling your subscription and contacting support.

Indemnification

You agree to indemnify and hold harmless BankDataPro, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration, except where prohibited by law. You retain the right to bring claims in small claims court where applicable.

Data Processing Agreement

When you upload financial documents to our Service:

• You grant us permission to process these documents solely for the purpose of providing the conversion service
• You represent that you have the right to upload and process these documents
• You acknowledge that documents are automatically deleted after 24 hours
• You are responsible for downloading converted files before they expire
• We do not access, read, or use your financial data for any purpose other than providing the service

Free Trial and Free Tier

We offer a limited free tier for new users:

• One free conversion per 24-hour period
• File size limited to 5MB
• Basic conversion features only
• Subject to availability and fair use

We reserve the right to modify or discontinue the free tier at any time.

Prohibited Activities

The following activities are strictly prohibited:

• Uploading documents obtained through fraud, theft, or illegal means
• Processing documents belonging to others without authorization
• Using the Service for money laundering or financial crimes
• Attempting to circumvent usage limits or credit requirements
• Reselling or redistributing our Service without authorization
• Using automated scripts or bots to abuse the Service
• Sharing account access with multiple individuals
• Uploading malicious files or attempting to compromise our systems

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Privacy Policy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data collection and usage practices.

Third-Party Services

Our Service may integrate with third-party services for payment processing, authentication, and document processing. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the practices of third-party service providers.

Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use the Service in any country subject to U.S. embargo or on any U.S. government prohibited parties list.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BankDataPro regarding the use of the Service and supersede all prior agreements and understandings.
